1. Introduction
These Terms of Service govern the provision of survey services by Surveyor Topographer ("we", "us", "our") to our clients ("you"). By commissioning survey services from us, you agree to be bound by these terms.
2. Our Services
We provide professional topographic and land survey services, including but not limited to topographical surveys, measured building surveys, 3D laser scanning, flood risk assessment surveys and boundary surveys. The specific scope of services for your project will be set out in our written specification and quotation.
3. Quotations and Acceptance
All quotations are provided in writing and remain valid for 30 days from the date of issue. A contract is formed when you confirm acceptance of our quotation in writing (including by email). We reserve the right to withdraw a quotation prior to acceptance.
4. Access and Site Conditions
You are responsible for ensuring that we have safe and reasonable access to the survey site on the agreed survey date. If access is restricted or conditions prevent the survey from being completed as specified, additional charges may apply for return visits.
5. Deliverables
Survey deliverables will be as specified in the agreed specification. All drawings are produced in AutoCAD DWG format as standard, referenced to Ordnance Survey grid and datum, unless otherwise agreed in writing. Ownership of deliverables transfers to you upon receipt of payment in full.
6. Accuracy and Limitations
Our surveys are carried out to professional standards using appropriate equipment and methods. However, we cannot guarantee the accuracy of data relating to underground features (pipes, cables, foundations) that are not visible or accessible at the time of survey. We recommend independent utility location surveys where subsurface services are a concern.
7. Payment
Payment is due within 30 days of the invoice date unless otherwise agreed in writing. Late payment may attract interest at 8% per annum above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
8. Limitation of Liability
Our total liability to you for any claim arising from our services shall not exceed the total fee paid by you for the relevant survey. We are not liable for indirect, consequential or economic losses.
9. Governing Law
These Terms of Service are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
